Introduction

Welcome to Books2Africa Nigeria! These Terms of Service (“Terms”, “Terms of Service”) govern your use of our website www.books2africa.ng (the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you must discontinue use of the Site immediately.

Accounts

  1. Account Creation: To use certain features of the Site, you may need to create an account. You must provide accurate and complete information and keep your account information updated.

  2. Account Security: You are responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Use of the Site

  1. Permitted Use: You may use the Site for lawful purposes and in accordance with these Terms. You agree not to use the Site:

    • In any way that violates any applicable national or international law or regulation.

    • To exploit, harm, or attempt to exploit or harm minors in any way.

    • To transmit, or procure the sending of, any advertising or promotional material without our prior written consent.

  2. Prohibited Activities: You agree not to:

    • Use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party’s use of the Site.

    • Use any robot, spider, or other automatic device, process, or means to access the Site for any purpose.

Intellectual Property Rights

The Site and its original content, features, and functionality are and will remain the exclusive property of Books2Africa and its licensors. The Site is protected by copyright, trademark, and other laws of Nigeria and foreign countries.

Donated Books

  1. Non-Sale of Donated Books: Donated books must not be sold under any circumstances. All books donated to Books2Africa are intended solely for educational and charitable purposes. Donors provide these books with the understanding that they will be used to support literacy and educational initiatives. Any attempt to sell, barter, or exchange these books for profit is strictly prohibited and may result in legal action.

  2. Processing Fees Refund Policy: Processing fees can only be refunded if reserved donated books have not been collected or shipped to the project. Once the books are in transit or have been dispatched to their designated projects, the associated processing fees are non-refundable. We encourage donors to ensure their commitment before finalizing any donation and associated payments.

  3. Condition of Donated Books: Donated books are in a variety of used conditions and are not new. While we strive to ensure the quality and usability of all donated books, it is important to understand that the books may show signs of previous use, including but not limited to markings, annotations, and wear and tear. By accepting these terms, you acknowledge and accept the varied conditions of the donated books.

  4. Quantity Accuracy: The quantity of donated books in each box may be slightly inaccurate due to errors with our inventory software but will not be more than 10% off. We make every effort to ensure that the number of books listed in each donation is accurate; however, occasional discrepancies may occur. If you receive a box with a quantity that differs from the stated amount by more than 10%, please contact us for resolution.

Termination

We may terminate or suspend your account and bar access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Limitation of Liability

In no event shall Books2Africa, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  1. Your access to or use of or inability to access or use the Site;

  2. Any conduct or content of any third party on the Site;

  3. Any content obtained from the Site; and

  4. Unauthorized access, use, or alteration of your transmissions or content.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions.

Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
